These Terms and Conditions ("Terms") apply to your use of organicmushroomsupplies.com (the "Website") and to any order you place with us. By using the Website or placing an order you agree to be bound by these Terms. Please read them carefully before ordering.
1. Who We Are
Organic Mushroom Supplies is a UK limited company trading from Unit P3, Riverside Industrial Estate, Bridge Road, BN17 5DF, United Kingdom. You can contact us by email at info@organicmushroomsupplies.com or by phone on 0800 669 6829, Monday to Friday 08:30-17:30 and Saturday 08:00-11:00.
2. Use of the Website
You must be at least 18 years old to use this Website or purchase products from us. You agree to use the Website only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use and enjoyment of, the Website by any third party. You must not misuse the Website by knowingly introducing viruses, trojans, worms or other malicious or technologically harmful material, or attempt to gain unauthorised access to the Website or any server, computer or database connected to it.
3. Intellectual Property
All content on the Website, including text, graphics, logos, images and software, is the property of Organic Mushroom Supplies or our licensors and is protected by copyright and other intellectual property laws. You may view, download and print material from the Website for your own personal, non-commercial use, provided you do not modify the content and you keep all copyright and proprietary notices intact.
4. Our Products
We sell gourmet mushroom growing supplies, including grow kits, substrates, liquid cultures, cultivation equipment, tinctures and related products. We do not sell spore syringes, spore swabs, spore prints, or any product marketed for the cultivation of psilocybin-containing "magic" mushrooms. Product images are for illustrative purposes; actual products may vary slightly in appearance. We take reasonable care to ensure that descriptions and details of products on the Website are accurate, but we do not guarantee they are completely accurate, current or error-free.
5. Orders and Availability
When you place an order, we will send you an email acknowledging receipt. This acknowledgement does not constitute acceptance of your order. A contract between us is only formed when we send you confirmation that your goods have been dispatched. We reserve the right to refuse or cancel any order, for example where a product is unexpectedly out of stock, where there has been a pricing or listing error, or where we suspect fraudulent activity. If we cancel an order after payment has been taken, we will provide a full refund.
6. Price and Payment
All prices on the Website are shown in pounds sterling (GBP) and include VAT where applicable. We accept payment by card and other methods via Wix Payments, as well as Apple Pay and Google Pay. Payment is taken at the time of order. We take reasonable care to ensure prices are correct at the time of publishing, but errors may occasionally occur; if we discover a pricing error in your order, we will contact you before dispatch to give you the option of reconfirming at the correct price or cancelling.
7. Delivery
We deliver to addresses within the United Kingdom. Our standard delivery charge is £6.75 per order on a 24-hour courier service. Please allow 1-2 working days for your order to be processed and dispatched before it enters the courier's 24-hour delivery window. Delivery times are estimates and not guaranteed; we are not responsible for delays caused by the courier or by circumstances beyond our reasonable control. Risk in the goods passes to you on delivery, and ownership passes once we have received payment in full.
8. Your Right to Cancel
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, if you are a consumer buying from us within the UK, you have the right to cancel your order within 14 days of receiving your goods, without giving a reason. To exercise this right, contact us at info@organicmushroomsupplies.com or use the Model Cancellation Form at the end of these Terms. This right does not apply to goods that are made to your specification, are perishable, or that become unsealed after delivery and are not suitable for return for health or hygiene reasons (for example, opened substrate or liquid culture products), unless the goods are faulty.
9. Returns and Refunds
If you cancel your order under Section 8, you must return the goods to us at your own cost, in their original condition, within 14 days of telling us you wish to cancel. We will refund the price of the goods, including standard delivery charges, within 14 days of receiving the returned goods (or evidence that you have sent them back), using the payment method you used to order.
10. Faulty or Damaged Goods
Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015. If a product you receive is faulty, damaged, or not as described, contact us at info@organicmushroomsupplies.com as soon as possible with your order number and photographs of the issue, and we will arrange a replacement, repair or refund as appropriate.
11. Our Liability
We supply products for domestic and private use. We are not liable for any loss of profit, loss of business, business interruption, or loss of business opportunity. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by law.
12. Growing Mushrooms Safely
Mushroom identification requires expertise. Any advice, guides or blog content on the Website is provided for general educational purposes only. You are responsible for correctly identifying any fungi before consumption and for following relevant food safety and cultivation guidance. We accept no liability for misidentification or misuse of our products.
13. Links to Other Websites
The Website may contain links to third-party websites. We have no control over the content of those sites and accept no responsibility for them or for any loss or damage arising from your use of them.
14. Changes to These Terms
We may update these Terms from time to time to reflect changes in our business or the law. The version published on the Website at the time you place an order will apply to that order.
15. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes arising from these Terms or your use of the Website are subject to the exclusive jurisdiction of the courts of England and Wales.
